Policy on the Use of Claims History Statement in the Motor Insurance

1. Introduction

In accordance with the Motor Vehicles (Third Party Liability Insurance) Law (Law 96(I)/2000) and its amending laws, and in harmonization with the practices of the Member States of the European Union, as per Article 16 of Directive 2009/103/EC, Cosmos Insurance Company Public Ltd (the “Company”) is required to issue a Claims History Statement for its insured clients and to obtain a corresponding Statement from other insurance companies for prospective insureds, in line with the standardized document established by the Insurance Association of Cyprus (“IAC”).

2. What is the Claims History Statement in the Motor Insurance Sector.

The Claims History Statement (the “Statement”) is a document (in printed or electronic form) that includes information regarding the insurance history, such as the insurance period, vehicle registration number, insurance policy details, and the insured’s claims record. The Statement must provide information covering at least the last five (5) years.

It has a uniform format across all European Union Member States to facilitate its use when an insured changes insurance companies within Cyprus, or when moving from one EU Member State to another.

3. Purpose of Issuance

The Claims History Statement is issued to ensure transparency and to facilitate the mobility of insured persons between insurance companies within the European Union.

4. Access and Provision

The Statement is provided free of charge to any insured person (individual or legal entity) who maintains or previously maintained a motor insurance policy with an insurance company within the European Union, upon their written request. The insurance company is obliged to provide the Statement to the policyholder within fifteen (15) days from the date of submission of the relevant application.

5. Use and Role of the Statement

The Claims History Statement:

  • Is used exclusively for motor insurance purposes
  • Provides evidence of the insurance history
  • Is taken into account by the Company’s risk assessment department and may affect pricing, the granting of discounts or more favorable terms for the insured, or even the insurability of the risk
